Latest eruption from Bill ‘Your son was a homo’ James: ‘de-infest areas where gays congregate’

Bill James isn’t through making headlines; he clearly has difficulty coping with his fellow Mecklenburg County Commissioners voting to extend domestic partner benefits to county employees—and that includes same-sex couples.

He not only didn’t apologize to Democrat Commissioner Vilma Leake when her referred to her late son, who succumbed to AIDS, he’s spewing more homophobic bullsh*t. The latest:

Homosexual conduct is illegal in NC (even after Lawrence V Texas). We arrest 250 homosexuals each year in Mecklenburg alone for either a ‘crime against nature’ or ‘solicitation of a crime against nature’. Unlike prostitution (exchanging money), even suggesting homosexual sex is a criminal offense in NC. If we were all that ‘progressive’ would we be arresting 250 homosexuals a year? Setting up sting operations to de-infest areas where they congregate? Point is, if you want to delude yourself that homosexual conduct is ‘ok’ go ahead. The law, the police and the DA however have a different view.”

BTW, he’s right about the Crimes Against Nature law here. It’s still on the books and while Lawrence v. Texas supercedes it, the police can still make an arrest, put someone in the pokey and basically shame the hell out of them publicly until the case is tossed out. Oh, and he elaborated to Matt Comer of Q-Notes about “de-infest”:

James responded: “I think that if you’re someone who is homosexual and you believe that you are born that way and have every right to engage in that behavior, I think the offensive thing, I would surmise, is not the word ‘infest’ or ‘de-infest’ but the fact that the police are actually doing the sting operations. We can parse words — what phrase should I have used? But the central question for most people is not what particular term got used but whether the action was occurring. Was I accurate in saying there are these sting operations going on and those sting operations — whatever term you want to use — target homosexual men? That is why the county took and spent significant amounts of money to rework the park to take out certain landscaping things to prevent, once the sting operations cleared them out, prevent them from re-congregating — or re-infesting if you use my original term.”

The cretin is on a roll now; hate mail must give him a boner (Wjames@carolina.rr.com).

You can also politely let Commission Chair Jennifer Roberts know that language in a reprimand cannot be harsh enough,as LGBT youth groups in Charlotte are outraged by James’s bigotry, given he’s a public servant. She’s been a wonderful ally for years; I interviewed her back in 2005 when James was last in significant eruption mode. But what’s more important is to thank the Commission for doing the right thing and supporting the County’s gay and lesbian employees and their committed relationships.

Oh, and in another spin on his non-apology to Leake, take a look at this:

[H]is comments weren’t meant to be derogatory and that “homo” was a slang word he used when growing up. “People can believe whatever they want, they can believe in the tooth fairy and legend of Atlantis,” James said. “I don’t determine what I do based on what people think. I determine it based on what I did and what I did was I asked a question and that question doesn’t deserve or require an apology.

James is wrong, I think, on the illegality of suggesting same-sex sex: under Lawrence v. Texas same-sex sex cannot be prosecuted and it seems unlikely that suggesting lawful activity can be prosecuted under basic First Amendment principles: it is the advocacy of ILLEGAL activity that can under some circumstances be prosecuted. 

I guess if one suggests that the activity take place in public parks, that’s different as Lawrence covers private consenual conduct.

That said, I certainly find the idea of sex in public places highly offensive; it was more understandable when private same-sex relations and gay bars could be prosecuted legally but today, for heaven’s sake, get a fucking hotel room and leave the toilets to self-hating losers like Larry Craig.  Charlotte does have gay bars and other gay establishments for folks who want to avoid alcohol or are in 12-step recovery.

And is James equally opposed to straight sex in public places, or is only same-sex sex worthy of condemnation?

When I hear the term “de-infest” used in reference to human beings (gay or otherwise) why am I reminded of the Third Reich - as in Hitler ordering the “de-infestation” of Jews from the Warsaw ghettos?

Not that I’m suggesting that Mr. James is calling for gays to be rounded up, and shipped off to death camps today. However, had he been an adult in a different decade (say, the 1930s), and a different country (say, Germany) based on his statements on gays (and say, non-whites) such a stance may not be a difficult stretch for him.

@ Bruce Godrey, # 2.  The guys being picked up in parks and restrooms are the married guys.  You are right.  Out gay men have many places to meet, plus internet sites like Manhunt.  I suspect that law enforcement enjoys terrorizing the married guys.  Maybe we could change the culture so that people no longer feel the need to hide?

jackspratt is spot-on. Almost all of the men arrested in parks and rest stops these days consider themselves straight-identified. An Atlanta patrol officer conducting a sting was interviewed by CNN:

CNN’s KYRA PHILLIPS: And tell me about the type of people that you arrested. I mean, give—can you tell me—well, first of all, let me ask you, have you arrested anyone that is well known like a politician or someone of famous stature?
MAJ. DARRYL TOLLESON, ATLANTA POLICE DEPARTMENT: No, I wouldn’t say that. But we have arrested certainly some high-profile people. It ranged from CEOs, bank presidents…
PHILLIPS: Oh, my gosh.
TOLLESON: ... professors, college professors. So, it really runs the gamut as far as who we actually apprehend and who has been involved in this in the past.
PHILLIPS: Are they gay? Are all of them gay?
TOLLESON: I can’t say. I can only tell you that a good majority of these men do have families. And that’s been a little bit shocking to us. You would think that it would be more of a gay issue. But overwhelmingly more and more we’re seeing that these are people with families.
PHILLIPS: Wow.

It happens all the time—look at Larry Craig, Bob Allen, almost every pastor caught at a rest stop or airport sting is married. Out gay men don’t need that outlet (save those who like the danger of these kinds of encounters), so it’s relegated to those who cannot be honest with themselves or anyone else about their bi/homo selves.

If they’re arresting for “crimes against nature” rather than public lewdness, then they’re making arrests which they know to be unlawful. James is advocating unlawful behavior with the intent that people engage in it, and the knowledge that some of the people he is addressing will in fact do so in the near future. Good thing criminal conspiracy isn’t against the law in NC…

We have a problem with public sex in the park I work in, but it is by no means confined to men cruising for men.  A good deal of the people arrested are hetero couples, and the charge for all is open lewdness.

Like #11 Paul’s comment, Lawrence v. Texas makes an arrest for private sexual behavior self-evidently unlawful, and therefore a section 1983 civil rights violation, regardless of what North Carolina law says.  Public sexual behavior, gay or straight, is a different thing.  William James seems rather ignorant of laws the County is supposed to enforce.
