Not even Brown v. the Board of Education?

Sarah Palin, when challenged to name a SCOTUS decision besides Roe v. Wade, couldn’t come up with one.

Unsurprisingly, the McCain campaign is holding CBS responsible for daring to think that might be something a major presidential nominee ought to know, and isn’t holding Palin responsible for, you know, not knowing.

Considering that the constituency that Palin was nominated to appease—-the religious right—-is more interested in the court appointments than any other factor, this is especially baffling.

Lessee - Dred Scott?  Bush vs Gore? The one which established corporate personhood - Everson Railroads or some such title?

That’s off the top of my head - and I’m 12,000 mile away and have never set foot in your country.

...a long time ago, some men decided to make America.  One of the most important parts of America was the Supreme Court.  But when America started, they weren’t sure what the Supreme Court should do.  So the Supreme Court people (justices?) got together once a week and just talked about stuff.  They did this for 184-years.  They didn’t stop because they knew they would have something important to do someday.

And then somebody asked them if <strike>abortion</strike> baby killing was okay.  And the Supreme Court said yes, which was a very big mistake.  The end…

Comment #4: MikeEss  on  09/29  at  10:25 PM

It’s oddly comforting that Palin doesn’t know about Brown v. Board of Education. If she did, odds are better than even that she’d be again’ it.

Comment #5: ploeg  on  09/29  at  10:25 PM

Gah! Forgot Bush v. Gore.

How about Plessy v Ferguson?

Comment #8: rorycalhoun  on  09/29  at  10:29 PM

New York Times v. Sullivan, which established the “public figure” standard for libel suits, insuring that politicians couldn’t use litigation to muzzle the press. Anyone who’s spent 15 minutes in journalism school knows that one. Doesn’t Palin have a journalism degree?

Comment #9: Bitter Scribe  on  09/29  at  10:34 PM

Alaska v. Native Village of Venetie Tribal Government, maybe, which basically said that Alaskan natives are not native Americans?

(IANAL.)

Comment #10: Auguste  on  09/29  at  10:39 PM

“Doesn’t Palin have a journalism degree?”

...of course not.  She has that other Degree, you know, the one for women...

Comment #11: MikeEss  on  09/29  at  10:42 PM

...buh?

I’m afraid to even think of the number of cases I could name off the top of my head.

Please let this make headlines.

Comment #12: Rebecca  on  09/29  at  10:47 PM

Miranda vs. Arizona is kind of an important one, although who knows if we’d still have Miranda rights under Palin?

Comment #13: Lauren O  on  09/29  at  10:49 PM

Its’ Dred Scott.

How about Miranda v. Arizona (everyone who watches L&O;should know this)
Lawrence v. Texas (wingnuts hate this one striking down sodomy laws)
Griswold v. CT (right to privacy re: contraception)
US v. Nixon (the President is not above the law)
Gonzales v. Carhart (late-term abortion ban)

Half of these you would have learned in US history class in frickin’ HIGH SCHOOL!

Comment #14: CParis  on  09/29  at  10:51 PM

Oh, that’s pathetic. Every pro-life brainwashing session I’ve ever suffered through (and there were plenty) made a big deal about the Dredd Scott decision and how Roe v. Wade was a direct analogy to it. Geez, Dredd Scott is a fucking DOG WHISTLE to the religious right.

And surely during anti-choice training, they’ve mentioned Griswold v Connecticut a few times—that’s the birth control decision.

If she hung out with more educated racists, she’d certainly have heard of Brown v. BoE and Loving v. Virginia. Hell, Loving v. Virginia is a hot topic in the current gay marriage debate.

And the other homo-agenda one, from 2000—whasisname v. Texas that struck down the Texas sodomy laws.

Not one of those is obscure or quaint: those are just the ones that in the middle of important current issues.

Comment #15: Dorothy  on  09/29  at  10:51 PM

Jesus, not even Lawrence vs Texas?  Isn’t that case the second worst SCOTUS ruling (after Roe) since it meant that you couldn’t bust into a gay person’s home to throw them in jail for committing sodomy in private?

Comment #16: ol cranky  on  09/29  at  10:52 PM

There’s always DC v. Heller, which was less than six months ago and is a big deal for the NRA types that Palin is supposed to appeal to.

The fact that she couldn’t come up with a second decision is beyond mere ignorance. It’s weird.

Comment #17: pillsy  on  09/29  at  11:00 PM

Sorry, typo about “Dredd Scott”. My dyslexia again…

Comment #18: Ben D.  on  09/29  at  11:02 PM

It’s worse than not being able to name other cases:

“Palin was apparently unable to discuss any major court cases.”

It’s one thing to blank out on case names, but another not to be able to discuss the significance of any other cases.

Comment #19: Brian Schmidt  on  09/29  at  11:04 PM

just by going to school and paying *slight* attention, anyone should be able to NAME at least Brown v. Board of Ed, or Plessy v. Ferguson, or yes, the Dred Scott case.

Not necessarily be able to do much more beyond naming them, but I would expect someone with a GED to be at least able to name, off-hand.

But why are we incredulous? This is the same lady who casually tells people that people and dinosaurs co-existed 6,000 years ago.

She’s the “like such as the Iraq” candidate.

Comment #20: josh dobbin  on  09/29  at  11:06 PM

To hell with “what a VP ought to know”... lets talk what a GOVERNOR ought to know!

Loving vs. Virginia
Brown vs Board of Education
Poll tax abolishment
Sodomites vs Texas
various doings with interstate trade (which she wanted to violate on the container tax)

I’m sure there are other FEDERAL trumps STATE and LOCAL rulings that would be of CURRENT interest to Failin!

Comment #21: Ms Kate  on  09/29  at  11:15 PM

No kidding. Kelo? Heller? They couldn’t even prep her on SCOTUS Decisions Important to the Wingnut?

My Alaskan relatives tell me the general consensus about Palin since her nomination has been “dumb as a stump”. I guess they’re right.

Comment #22: mythago  on  09/29  at  11:16 PM

Comment #24: Roxanne  on  09/29  at  11:18 PM

Alaska - an excellent place for active recreation! Particularly among entertainment in Alaska certainly stands out fishing! Alaska Fishing is fundamentally different from that of fishing, to which we are accustomed to in their own homes, in their waters. This is indeed Activities and a great way to feel the spirit of Alaska - that beautiful and unique land!
The best time for fishing in Alaska - from April to September!

Comment #25: denyffishh  on  09/29  at  11:23 PM

Given her inability as mayor to conduct a legal property acquisition, I would have thought she’d have at least a passing interest in Kelo v. New London…

Doesn’t she remember Bakke vs. University of California, Davis? You know, the affirmative action ruling?  No surprise there. In fact, I think George W. couldn’t remember the facts about this one in his “masterful” debate with Gore.    .....sigh

Comment #30: Eric, Rejector of Memez  on  09/29  at  11:42 PM

I’m with pillsy on Heller.  Even if she limited her answer to recent court decisions having current impacts, Heller springs immediately to mind, and, as pillsy noted, it’s right in her ideological and personal wheelhouse.  It should have gone out of the park.

Comment #31: seeker6079  on  09/29  at  11:45 PM

These are the ones I can quote form oral memory. Spelling may be wrong:

Marbury vs Madison
Sweat vs Painter (pre-Brown education case in TX. Paved way for Brown)
Lawrence vs Texas
Bush vs Gore
Plessy vs Furguson.
Miranda vs Arizona.
Dredd Scott

I am not a legal scholar. I picked all this up by being a smart person who paid half assed attention in class and through listening to local folklore. I guess I’m qualified to be VP then.

BTW, UK Pandagonians: I sometimes wath British cop shows and notice that arrestees are sometimes given a warning similar to the Miranda warning. When did this come about ?

Comment #32: Bacopa  on  09/29  at  11:49 PM

Of course Palin is much more experienced and qualified than Obama, who probably could go on for hours about Supreme Court decisions in the greater context of social movements in US history and the presidency.

Heck, he probably mumbles more about supreme court decisions in his sleep than Palin even knows, at least until Michelle drops a pillow over his head and/or gives him a gentle kick.

Comment #33: Ms Kate  on  09/30  at  12:02 AM

Gideon v. Wainwright—the accused has the right to be provided with counsel free of charge if he cannot afford it.

It’s the other half of the “Miranda” warning.  Jeez, didn’t she even watch “Adam 12” as a kid?

Comment #35: Captain Bathrobe  on  09/30  at  12:33 AM

Ms Kate, I’m sure Michelle has better ways to stop Barack from mumbling about the supreme court.

And I can think of another court case, Bourne vs Archdiocese. I’ve been to Bourne. Great place to hear central TX German accents. Czech accents too. The court ruled churches could not break istoric district and zoning laws.

Thanks Dan for the info about UK law. I will eat Bananas Foster in your honor

Comment #36: Bacopa  on  09/30  at  12:34 AM

In Norway, you get a pamphlet in 12 languages.

Comment #37: Erl  on  09/30  at  12:38 AM

Screw the DC gun case. It’s not about personal protection. I’ve got a WWII Filipino sword plundered by my gayest great uncle. Back in WWII they didn’t care how gay you were. I also have a spring steel Peshawar kukri. I would break the law if I walk out the front door with either, yet I could easily get a license to pack an automatic secretly.

I’ve got a sjambok on the way. I won’t carry a gun and my knives/swords are illegal outside my home. Sjamboks are not mentioned in the law.

Comment #38: Bacopa  on  09/30  at  12:52 AM

Er, Kate, you do know what Obama was a professor of, back in the University of Chicago, right?

Comment #39: Phoenician in a time of Romans  on  09/30  at  12:55 AM

Some ones not mentioned yet:
Ledbetter v Goodyear - must sue for pay discrimination within 180 days of hiring.
The 1986 case confirming criminal law for sodomy - the one overturned in 2003 by another SCOTUS decision, Lawrence v Texas
The 1992 case overturning Amendment 2 in Colorado, the one that prohibited all counties, municipalities, other sub-state jurisdictions from enacting gay rights measures in perpetuity
Right now I am blanking on names of some of the separation of church and state cases

If I weren’t so tired after 14 hours of work, I’d remember more names - and I am a science geek, not a poli sci major or a lawyer or a journalist. I just happen to be a sentient citizen.

Comment #40: NancyP  on  09/30  at  01:11 AM

Great, the spambots are out.

Off the top of my head:
Plessy v. Ferguson
Brown v. Board
Lemon v. Kurtzman
Gore v. Bush
Falwell v. Hustler

But hey, I’m not running for VP or anything, why should I know this stuff?

Comment #41: Damian  on  09/30  at  01:37 AM

Wood v. Carpenter?

Comment #42: Sean Foley  on  09/30  at  01:39 AM

Some more important ones (in no particular order)....

The Slaughter-house Cases
Korematsu v. U.S.
Cherokee Nation v. Georgia and Worcester v. Georgia
Bowers v. Hardwick
Furman v. Georgia
Buck v. Bell
Lochner v. New York

But most of all I agree with those who’ve expressed surprise at Palin’s lack of knowledge of the wingnut SCOTUS canon.  I mean, we all know she’s unqualified to be VP. But I would have thought that she’d be able to become a fine, cheetoh-stained rightwing blogger.  Apparently Malkin and TIDOS Yankee don’t have to worry about any new competition!

Comment #43: Ben Alpers  on  09/30  at  01:56 AM

I will say that when Olbermann was covering this, I had a big struggle myself coming up with names.  I eventually remembered Dred Scott and then Plessy vs. Ferguson… Marbury vs. Madison… and there was one involving Dartmouth College…  Bah, embarrassing.  And I recognize almost all of the ones that have been cited on this thread, but I didn’t remember them when I tried to build a little list.

Oh well, I guess I just blew my chances at becoming Vice President this year.

Comment #44: FlipYrWhig  on  09/30  at  02:03 AM

Tinker vs Des Moines?

Of course, I went to school with the children of the Mary Beth Tinker, so it might be more important to me and mine than others.

Comment #45: karpad  on  09/30  at  02:06 AM

OK, I give up. What does she care about enough to actually learn something about it?

Comment #46: Quaker in a Basement  on  09/30  at  02:27 AM

Wow, everyone, I’m impressed. I could maybe name Brown v. Board of Education, but that’s about it. Guess I’m not that up on the Supreme Court.

Of course, I’m not running for Vice President…

Comment #47: atheist  on  09/30  at  03:28 AM

Honestly, I couldn’t name any when on the spot, but I could gesticulate and say I know of many of them and their effects…

Comment #48: Crissa  on  09/30  at  03:34 AM

Kelo would be of interest to someone who as mayor abused eminent domain without even securing the property in the first place.  Ring v. Arizona and Lewis v. Casey, along with Miranda might influence her interpretation of terrorist defendant “rights”.  Then there are the cases involving school prayer, the non-Supreme Court but Federal cases involving Intelligent Design, the recent case (Boumediene? I never bothered to learn the spelling) saying even “proven” terrorists get a day in court to have the government “prove” they are “terrorists”, and others.

Let’s see: incurious about foreign policy, incurious about governing, incurious about history, incurious about foreign places, incurious about natural history, incurious about damn near everything…. One could almost assume she’s determined to remain an ignorant ass.

I donated $100 to Obama yesterday.

Comment #49: jon  on  09/30  at  05:03 AM

I want the Lance Henricksen credit card!

Was it listing all the court cases that embolderated the spambots?  And how do they make Russian Cyrillic characters?  pemoHt (remote) iphone may be my favorite of those.

Topic?  Even Palin’s tutors thought she must know Bush v. Gore or the lawrence v. Texas.  Even if not by name.

Comment #50: Caren-Sun-blocking Creator of Animorphic Pancakes  on  09/30  at  08:36 AM

I would also like the Lance Henrickson credit card. I would tap it in the space between my splayed fingers; first slowly, then with an increasing rapidity that became a blur of automated motion.

Comment #51: joshdobbin  on  09/30  at  08:42 AM

Oh come on people, no one mentioned the most famous SC decision of all:

Spy vs. Spy

I’m sure that Mooselini knows that one.

Comment #52: General Woundwort  on  09/30  at  09:11 AM

Even if she did remember Bush v. Gore, even Palin isn’t stupid enough to remind anybody of that disreputable mess.

Even as SCOTUS handed it down they wanted it to disappear.  Even though Nino Scalia and the rest of them (who are still alive) want to pretend it never happened, it will still go down in history as a black mark against that court, and, in light of the devastation to America it ushered in, history’s judgment of them will be most unkind…

Comment #53: MikeEss  on  09/30  at  09:35 AM

Off the top of my head:

Lawrence v Texas
Bush v Gore
Brown v Board of Education
California v Bakke
Miranda v Arizona

Comment #54: The Wanderer  on  09/30  at  09:54 AM

My first assumption on hearing of the question was that they weren’t asking about classic USSC cases, but rather current ones with active political implications.  Far fewer of those.  But even then Heller, Lawrence<i> and <i>Bush v. Gore all are the past decade and all have very current implications in areas in which one would expect Palin to be knowledgeable, even if only from a propagandist’s view: guns, religion/teh gayz, and how to steal the next election.

And can we please do something about the spambots?  Delete their posts or something.

Comment #55: seeker6079  on  09/30  at  10:32 AM

Kelo is a big one to the black helicopter guys who support her, too.

Comment #56: Amanda Marcotte  on  09/30  at  10:39 AM

My first assumption on hearing of the question was that they weren’t asking about classic USSC cases, but rather current ones with active political implications.

So, Roe. Classic or current?

Seriously, though; the Christianists aren’t ever going to let go of Roe. Assuming that they’re still an active political force twenty years from now (and I can’t see how they won’t be), they’ll still be going on about Roe. They’ve let themselves be defined by their opposition to Roe almost to the exclusion to anything else.

Comment #57: protected static  on  09/30  at  10:45 AM

No one’s mentioned Hamdan or Hamidi yet, the Gitmo Habeas Corpus cases, which Gov. Palin should most certainly know, what with her extensive foreign policy experience of looking at Putin rearing his ugly head over the horizon.

Comment #60: Theaetetus  on  09/30  at  11:14 AM

The two I thought she’d have had were the takings case from two years ago and the DC gun ban.  Activists conservatives are all over those two.

And there are fundies in my idaho town with lobes missing who could tell you: dred scott, dred scott!

And shouldn’t the handlers have prepped her on Ledbetter?

My guess: she wasn’t sure she’d get the name or the facts right, so she demurred.

Comment #62: sophie brown  on  09/30  at  12:07 PM

Wasn’t there just an SC case decided in the last year about the Exxon Valdez oil spill damages?  Which directly affected the state of which Palin is governor?  I’d think she’d know that one even if she didn’t know Brown, or Lawrence, or Kelo, etc.

Rumsfeld v Padilla (yeah, the court punted, but it was an important, if wrong IMHO, punt)

Ex Parte Merryman (granted, I found those while looking for Padilla, but still)
Ex Parte Quirin

Those are all kind of important in our war on emotions.

Hi

The School of Medicine is pleased by the U.S. Supreme Court’s decision released today. The Court let stand a unanimous 2007 ruling by the 8th U.S. Circuit Court of Appeals that stated prostate tissue and serum samples donated to Washington University can continue to be used by the institution for cancer research. The appellate court had affirmed the lower federal district court ruling that donors who gave tissue or serum samples to the University for research can’t later compel the school to transfer ownership of the samples to another research institution.

Chinese horoscope is made up of 12 zodiac signs. These signs represent different animals and these animals are dog, dragon, horse, monkey, ox, pig, rabbit, rat, rooster, sheep, snake and tiger. According to religious prodigy, Goutam Buddha once called up a meeting in the forest and these twelve animals were present there to attend the meeting. This makes these 12 animals so important in designing the astrological structure.
Your relationships are based on all the planets, signs, and houses in your birth chart. It is also based on how they interact with all the planets, signs, and houses, in other people’s charts.

“Relationship astrology” is a part of astrology which analyses just how compatible you are with someone else. It takes into account varied aspects between two people and also the type of relationship it is going to be, or not be.

This type of astrological study can tell whether two, or more, people are emotionally, mentally, or sexually compatible.
